DALLAS (AP) — The Internal Revenue Service says wrongly convicted inmates no longer have to pay federal taxes on compensation money received from states that locked them up.

Innocence Project of Texas policy director Cory Session said Monday that the IRS ruling affects ex-inmates from 32 states that compensate the wrongly convicted.

A group of wrongly convicted Texas inmates lobbied the agency that had in some cases collected up to a third of compensation money in taxes. Lawyer Kevin Glasheen led the lobbying effort after last year persuading the Texas Legislature to provide the nation’s most generous compensation package.

Texas pays the wrongly convicted $80,000 for each year of incarceration, plus a lifetime annuity that varies based on life expectancy and other factors

 

CA woman charged with terrorist aid

SAN DIEGO (AP) — A California woman has been charged with conspiring to provide money and people to a Somali terrorist group to help carry out killings in the African nation, according to a federal indictment unsealed Monday.

Nima Ali Yusuf, a 24-year-old permanent resident of the U.S., conspired in Southern California and elsewhere to aid al-Shabab, an al-Qaida-linked militia trying to create an Islamic state in Somalia, the indictment states.

Federal prosecutors did not provide further details on the allegations.

Since 2007, roughly 20 men have left Minnesota to fight with al-Shabab. Authorities said one became the first known U.S. citizen to do a suicide bombing when he launched an attack in Somalia.

The FBI said he might have been “radicalized” in Minneapolis.

It wasn’t immediately clear from the indictment whether Yusuf was connected to those men.

Yusuf was the fourth person charged in the past month in San Diego with helping al-Shabab. The others were accused of helping raise money and route funds to the radical Islamist group.

The indictments come as the U.S. government cracks down on those suspected of helping al-Shabab.

Earlier this month, the U.S. banned all cargo from Somalia in response to a plot by terrorists in Yemen who hid two powerful bombs inside printers shipped to Chicago.

A senior administration official, who spoke on condition of anonymity because he was not authorized to speak publicly, said there was no intelligence linking Somalia to a similar plot, but he said al-Shabab has said it intends to attack the U.S., just as al-Qaida in the Arabian Peninsula has stated and tried to do.

Yusuf was arrested Friday in San Diego and appeared in federal court Monday, federal prosecutor Sabrina Feve said.

Yusuf was charged in the indictment with conspiracy to provide material support to terrorists; conspiracy to provide material support to a foreign terrorist organization; and making a false statement to an FBI agent and Customs and Border Protection officer when she allegedly denied sending money to anyone in Somalia in the past year.

Yusuf was being held without bail pending a Nov. 18 hearing. It could not be determined if she had an attorney.

During the past two years, Minneapolis has been the center of a federal investigation into al-Shabab recruitment.

E.K. Wilson, a counterterrorism supervisor with the FBI in Minneapolis, said his office is coordinating closely with colleagues in San Diego, but added he could not comment on whether Yusuf is directly connected to the Minnesota men who went overseas to fight.

He referred questions to the FBI or U.S. Attorney’s Office in San Diego, where officials declined to comment further.

A total of 19 people have been charged in the case in Minnesota with a variety of counts ranging from providing material support to terrorists to perjury. Three men who went to Somalia and returned to the U.S. after spending time in al-Shabab training camps have pleaded guilty to material support charges in federal court in Minnesota and are awaiting sentencing.

Most of the other men who went to fight in Somalia are still at large. Some are dead or feared dead.

The defendants include two women accused of being part of a pipeline that routed money and fighters from the U.S. to al-Shabab by going door to door in Rochester, Minn., Minneapolis and other cities in the U.S. and Canada to fraudulently raise money for al-Shabab’s operations in Somalia.

They falsely claimed the donations would go to the needy and allegedly held teleconferences to make direct appeals for support for al-Shabab, according to the indictment.

The men who left Minnesota initially appeared to have been motivated not by anger at America but instead at turmoil in their Somali homeland. The country has not had a functioning government since 1991, when warlords overthrew a socialist dictator then turned on each other, plunging the African nation of 7 million into chaos.

WASHINGTON – Judges who hear Social Security disability cases are facing a growing number of violent threats from claimants angry over being denied benefits or frustrated at lengthy delays in processing claims.

There were at least 80 threats to kill or harm administrative law judges or staff over the past year — an 18 percent increase over the previous reporting period, according to data collected by the agency.

The data was released to the Association of Administrative Law Judges and made available to The Associated Press.

One claimant in Albuquerque, N.M., called his congressman’s office to say he was going to “take his guns and shoot employees” in the Social Security hearing office. In Eugene, Ore., a man who was denied benefits said he is “ready to join the Taliban and hurt some people.” Another claimant denied benefits told a judge in Greenville, S.C., that he was a sniper in the military and “would go take care of the problem.”

“I’m not sure the number is as significant as the kind of threats being made,” said Randall Frye, a judge based in Charlotte, N.C., and the president of the judges’ union. “There seem to be more threats of serious bodily harm, not only to the judge but to the judge’s family.”

Fifty of the incidents came between March and August, including that of a Pittsburgh claimant who threatened to kill herself outside the hearing office or fly a plane into the building like a disgruntled tax protester did earlier this year at the Internal Revenue Service building in Austin, Texas.

A Senate subcommittee is expected to hear testimony on Monday at a field hearing in Akron, Ohio, about the rising number of threats, as well as the status of the massive backlog in applications for disability benefits, which are available to people who can’t work because of medical problems.

Nearly 2 million people are waiting to find out if they qualify for benefits, with many having to wait more than two years to see their first payment.

Judges say some claimants become desperate after years of fighting for money to help make ends meet.

“To many of them, we’re their last best hope for getting relief in the form of income and medical benefits,” said Judge Mark Brown, a vice president of the judge’s union and an administrative law judge hearing cases in St. Louis.

While no judges were harmed this year, there have been past incidents: A judge in Los Angeles was hit over the head with a chair during a hearing and a judge in Newburgh, N.Y., was punched by a claimant when he showed up for work.

In January, a gunman possibly upset about a reduction in his Social Security benefits killed a security guard during a furious gunbattle at a Nevada federal courthouse.

About 1,400 administrative law judges handle appeals of Social Security disability claims at about 150 offices across the country. Many are in leased office space rather than government buildings.

Brown said the agency provides a single private security guard for each office building that houses judges. Frye said he has sought more security and a review of the policy that keeps guards out of hearing rooms. He said Social Security Commissioner Michael J. Astrue has promised to look into it.

Social Security Administration spokeswoman Trish Nicasio said the agency continually evaluates the level and effectiveness of office security and makes changes as needed.

“We are taking appropriate steps to protect our employees and visitors while still providing the level of face-to-face service the public expects and deserves,” Nicasio said.

Visitors and their belongings are screened before entering hearing offices and hearings room, she said, and reception desks are equipped with duress alarms to notify the guard immediately of any disturbance.

(CNSNews.com) – The Council on American-Islamic Relations (CAIR) has issued a travel warning to Muslim airline passengers on U.S. aircraft in response to the Transportation Safety Administration’s  “enhanced pat down” policy that went into effect in late October.

CAIR said Muslims who object to full-body scans for religious reasons should know their rights if they are required to undergo a pat-down, including asking for the procedure to be done in a private place. In addition, CAIR offered a “special recommendation” for Muslim women who wear a hijab, telling them they should tell the TSA officer that they may be searched only around the head and neck.

In the “special recommendations for Muslim women who wear hijab,” it states: “Before you are patted down, you should remind the TSA officer that they are only supposed to pat down the area in question, in this scenario, your head and neck. They SHOULD NOT subject you to a full-body or partial-body pat-down.”

It also states: “Instead of the pat-down, you can always request to pat down your own scarf, including head and neck area, and have the officers perform a chemical swipe of your hands.”

The new TSA pat-downs involving “head-to-toe” screening techniques follow recent airliner bombing attempts.  Passengers who reject a full-body scan or who are selected for secondary screening may be searched using the enhanced pat-down.

“Pat downs are one important tool to help TSA detect hidden and dangerous items such as explosives,” a TSA statement issued on Oct. 28 stated. “Passengers should continue to expect an unpredictable mix of security layers that include explosives trace detection, advanced imaging technology, canine teams, among others.”

Posted on its Web site under “TSA’s Head-to-Toe Screening Policies,” the agency said how people are dressed may lead to closer inspection, including baggy or loose clothing. Those policies also include individuals being searched by a “professional” of the same sex.

“It is TSA’s policy that passengers should be screened by an officer of the same gender in a professional, respectful manner,” the policy reads.

In February, the Figh Council of North America, a group of Islamic scholars, issued a fatwa, or religious ruling, that full-body scanners violate Islamic law.

“It is a violation of clear Islamic teaching that men or women be seen naked by other men and women,” the ruling states. “Islam highly emphasizes haya (modesty) and considers it part of the faith. The Qu’ran has commanded the believers, both men and women, to cover their private parts.”

CAIR endorsed the fatwa, according to a Feb. 21 article in the Detroit Free Press.

I, Tina Griego, journalist for the ;Denver Rocky Mountain News wrote a column titled, “Mexican Visitor’s Lament”- 10/25/07.

I interviewed Mexican journalist Evangelina Hernandez while visiting Denver last week.  Hernandez said, “illegal aliens pay rent, buy groceries, buy clothes. What Happens to your country’s economy if 20 million people go away?”  Hummm, I thought, what would happen, so I did my due diligence, buried my nose as a reporter into the FACTS I found below.

It’s a good question it deserves an honest answer. Over 80% of Americans demand secured borders and illegal migration stopped. But what would happen if all 20 million or more vacated America? The answers I found may surprise you!

In California, if 3.5 million illegal aliens moved back to Mexico, it would leave an extra $10.2 billion to spend on overloaded school systems, bankrupt hospitals and overrun prisons. It would leave highways cleaner, safer and less congested. Everyone could understand one another as English became the dominant language again.

In Colorado, 500,000 illegal migrants, plus their 300,000 kids and grand-kids  would move back ‘home’, mostly to  Mexico. That would save Coloradans an estimated $2 billion (other experts say $7 billion) annually in taxes that pay for schooling, medical, social-services and incarceration costs. It means 12,000

gang members would vanish out of Denver alone.
Colorado would save more than $20 million in prison costs, and the terror that those 7,300 alien criminals set upon local citizens. Denver Officer Don Young and hundreds of Colorado victims would not have suffered death, accidents, rapes and other crimes by illegals.

Denver Public Schools would not suffer a 67% drop-out/flunk-out rate because of thousands of illegal alien students speaking 41 different languages. At least 200,000 vehicles would vanish from our gridlocked cities in Colorado.  Denver’s 4% unemployment rate would vanish as our working poor would gain jobs at a living wage.

In Florida, 1.5 million illegals would return the Sunshine State back to America, the rule of law, and English.

In Chicago, Illinois, 2.1 million illegals would free up hospitals, schools, prisons and highways for a safer, cleaner and more crime-free experience.

If 20 million illegal aliens returned ‘home’, the U.S. Economy would return to the rule of law. Employers would hire legal American citizens at a living wage. Everyone would pay their fair share of taxes because they wouldn’t be working off the books. That would result in an additional $401 Billion in IRS income taxes collected annually, and an equal amount for local, state and city coffers.

No more push ‘1’ for Spanish or ‘2’ for English. No more confusion in American schools that now must contend with over 100 languages that degrade the educational system for American kids. Our over-crowded schools would lose more than two million illegal alien kids at a cost of billions in ESL and free breakfasts and lunches.

We would lose 500,000 illegal criminal alien inmates at a cost of more than $1.6 billion annually. That includes 15,000 MS-13 gang members who distribute $130 billion in drugs annually would vacate our country.

In cities like L.A., 20,000 members of the ’18th Street Gang’ would vanish from our nation. No more Mexican forgery gangs for ID theft from Americans! No more foreign rapists and child molesters!

Losing more than 20 million people would clear up our crowded highways and gridlock. Cleaner air and less drinking and driving American deaths by illegal aliens!

America’s economy is drained. Taxpayers are harmed. Employers get rich. Over $80 billion annually wouldn’t return to the aliens’ home countries by cash transfers. Illegal migrants earned half that money untaxed, which further drains America ‘s economy which currently suffers an $8.7 trillion debt.

At least 400,000 anchor babies would not be born in our country, costing us $109 billion per year per cycle. At least 86 hospitals in California, Georgia and Florida would still be operating instead of being bankrupt out of existence because illegals pay nothing via the EMTOLA Act.

Americans wouldn’t suffer thousands of TB and hepatitis cases rampant in our country-brought in by illegals unscreened at our borders.

Our cities would see 20 million less people driving, polluting and grid locking our cities. It would also put the ‘progressives’ on the horns of a dilemma; illegal aliens and their families cause 11% of our greenhouse gases.

Over one million of Mexico’s poorest citizens now live inside and along our border from Brownsville, Texas to San Diego, California in what the New York Times called, ‘colonias’ or new neighborhoods. Trouble is, those living areas resemble Bombay and Calcutta where grinding poverty, filth, diseases, drugs, crimes, no sanitation and worse. They live without sewage, clean water, streets, roads, electricity, or any kind of sanitation.

The New York Times reported them to be America’s new ‘Third World’ inside our own country. Within 20 years, at their current growth rate, they expect 20 million residents of those colonias. (I’ve seen them personally in Texas and Arizona; it’s sickening beyond anything you can imagine.)

By enforcing our laws, we could repatriate them back to Mexico. We should invite 20 million aliens to go home, fix their own countries and/or make a better life in Mexico. We already invite a million people into our country legally more than all other countries combined annually. We cannot and must not allow anarchy at our borders, more anarchy within our borders and growing lawlessness at every level in our nation. It’s time to stand up for our country, our culture, our civilization and our way of life.
